Trump Says He May Break Up 9th Circuit Court After Rulings Go Against Him

President Trump is considering breaking up the 9th Circuit Court after a federal district court judge in its jurisdiction blocked his order to withhold funding from “sanctuary cities.”

In a Wednesday interview with the Washington Examiner, Trump said “there are many people who want to break up the 9th Circuit. It’s outrageous.”

In the interview, Trump accused liberals of “judge-shopping” for a court that would strike down his executive order.

“I mean, the language on the ban, it reads so easy that a reasonably good student in the first grade will fully understand it. And they don’t even mention the words in their rejection on the ban,” Trump said.

Trump claimed the court oversteps its authority and that his opponents “immediately run” to the court for “semi-automatic” rulings.

The 9th Circuit earlier this year blocked Trump’s executive order that barred immigration from certain Muslim-majority countries and banned all Syrian refugees from the U.S. for a period of time.

Earlier Wednesday, Trump railed against the 9th Circuit over a judge blocking his order withholding funds from sanctuary cities.

If Trump decides to move forward with plans to break up the court, he’ll have Republican support. Earlier this year, Sen Jeff Flake (R-Ariz.) voiced support for breaking up the court, which is seen as one of the most liberal in the country.

On Tuesday, a federal judge rejected Trump’s order to defund sanctuary cities, arguing that the White House had overreached with requirements not related to law enforcement.

The 9th Circuit Court covers Arizona, California, Alaska, Nevada, Idaho, Oregon, Montana, Washington and Hawaii, as well as Guam and the Northern Mariana Islands.

Eighteen of the court’s 25 judges were appointed by Democratic presidents.

Reality

First of all, Trump is angry at the wrong court. The most recent ruling against Trump, in which Judge William Orrick issued an injunction blocking his executive order targeting so-called sanctuary cities, wasn’t handed down by the 9th Circuit. Orrick sits on the U.S. District Court in San Francisco, which is one level below the appeals court.

Donald Trump is still learning the Constitution. His hands are completely tied when it comes the the courts. Trump can’t break up a circuit court on his own. He needs the help of Congress, who would need a super-majority to pass. While most Republicans polled wouldn’t back it, Democrats alone could block any legislation to break up the 9th circuit.

Trump Blames Democrats for Shutting Down Park Service After Proposing Shutting Down Park Service

President Donald Trump uncorked a tweet storm on Thursday morning, lashing out at Democrats over a slew of different issues.

Trump’s Twitter tirade — six messages over the course of just two minutes — came a day before an expected congressional vote on appropriations that would seek to avoid a shutdown of the federal government.

The president’s tweets seemed to refer to threats by Democrats in Congress not to support that appropriations package if it does not include spending for Obamacare subsidies that lower the cost of out-of-pocket health expenses for low-income Americans.

If the government does not appropriate that money, which goes directly to insurers, those insurers that sell Obamacare plans will still be on the hook for the subsidies to customers, but will have to eat the cost of doing so.

But the tweeter in chief also teed off on Democrats on military spending, border security and national parks.

Reality

In Trump’s budget proposal to Congress, he suggested massive cuts of $1.5 billion dollars to the Department of the Interior which would have decimated the Parks Department.

 

Trump just blasted the wrong court for ‘blocking’ his sanctuary cities order

President Donald Trump lashed out again at the American judiciary for blocking a piece of his agenda.

Except on Wednesday, he got his court wrong.

In a morning tweet, he blamed the 9th Circuit Court of Appeals for blocking his order to withhold funding from so-called sanctuary cities. He called the ruling “ridiculous” and signaled that his administration will appeal by saying “see you in the Supreme Court.”

The problem: Tuesday’s ruling did not come from the 9th Circuit. It was made in federal district court in San Francisco.
Earlier this year, the 9th Circuit did block Trump’s executive order restricting travel from several predominantly Muslim countries.

White House chief of staff Reince Priebus also targeted the appeals court in comments to reporters Tuesday, according to The Hill.

Politico, which first pointed out Trump’s error, noted that the 9th Circuit would hear the case next if the Trump administration appeals.

Trump: ‘Media Will Kill’ Success of First 100 Days

President Trump took aim at the media early Friday morning, accusing journalists and news outlets of belittling and disparaging his early accomplishments in the White House.

Trump is set to hit the symbolic 100-day mark in his presidency on April 29. Those early days are typically considered a bellwether for a presidential administration and its ability to govern.

With little legislative achievement to speak of, Trump has focused on executive actions to roll back Obama-era regulations and climate policy.

The biggest success of Trump’s young presidency, alluded to in his tweet, has been the nomination and confirmation of Supreme Court Justice Neil Gorsuch, whom Trump picked to replace the late Antonin Scalia.

But some of the president’s highest-profile campaign promises have foundered in his first months in office.

Two controversial executive orders barring citizens of certain Muslim-majority countries and refugees from entering the U.S., for example, were blocked by federal judges amid concerns that the orders amounted to a ban on a religious group.

And a House GOP measure to repeal and replace ObamaCare ultimately failed after Speaker Paul Ryan (R-Wis.) pulled it amid dwindling support from Republican lawmakers.

Still, Trump has managed to make good on other promises, such as his vow to crack down on illegal immigration. He has already directed his administration to more aggressively enforce immigration laws and has authorized the construction of a long-touted wall along the U.S.-Mexico border.

Also casting a shadow over Trump’s first 100 days is a set of ongoing investigations into Russian election interference and potential ties between members of Trump’s presidential campaign and Moscow. Both the Senate and House Intelligence committees are probing the matter, and the FBI is conducting its own investigation.

Trump and his aides have repeatedly denied any collusion with Moscow, and the president himself has called the investigations a “witch hunt” akin to McCarthyism during the Cold War.

Trump Tweet Attacks Media, Democrats, and Obama Foreign Policy

As thousands began to gather on the White House lawn Monday for the annual Easter Egg Roll, President Trump again took on the media, the Democrats, and the Obama administration via one of his favorite activities: Tweeting.

“‘The first 90 days of my presidency has exposed the total failure of the last eight years of foreign policy!’ So true” Trump said in one post, hash-tagging the morning show Fox & Friends.

The tweet came in the wake of high-profile confrontations with Syria and North Korea.

The president then turned his attention to the Democratic Party, mock tweeting an endorsement: “A great book for your reading enjoyment: “REASONS TO VOTE FOR DEMOCRATS” by Michael J. Knowles.”

Yes, the book features blank pages.

Not to be left out, the media also took a shot during Trump’s early Monday Twitter storm: “The Fake Media (not Real Media) has gotten even worse since the election. Every story is badly slanted. We have to hold them to the truth!

It is unclear which story, or stories, prompted the president’s ire.

Trump Tells NBC to Stop Covering Russia Story

President Trump on Saturday called for NBC News to devote more attention to his unproven claims that President Obama spied on him and stop covering the investigations into Russia’s interference in the election.

“When will Sleepy Eyes Chuck Todd and @NBCNews start talking about the Obama SURVEILLANCE SCANDAL and stop with the Fake Trump/Russia story?” Trump tweeted just before 9 a.m.

“It is the same Fake News Media that said there is ‘no path to victory for Trump’ that is now pushing the phony Russia story. A total scam!” he added shortly after.

It was not immediately apparent what NBC coverage Trump was taking issue with. Chuck Todd on Friday interviewed top Washington lawyer Abbe Lowell and former Obama press secretary Josh Earnest on “MTP Daily” about the latest Russia developments.

Russian interference in last year’s election is the subject of investigations by the Senate Intelligence Committee, House Intelligence Committee and the FBI.

Trump’s former national security adviser Michael Flynn has volunteered to be interviewed by the FBI and congressional committees probing possible links between the Trump campaign and Russia in exchange for immunity from prosecution.

The president has frequently decried coverage of the investigations into Russian meddling as “fake news.”

Trump last month claimed in a series of tweets that Obama “wiretapped” him before the election. He did not supply any evidence.

FBI Director James Comey says he knows of “no information” validating Trump’s accusation. Trump has stood by the allegations, and the White House has said the comment refers to the Obama administration’s surveillance activities more broadly.

Trump Slams His Own SCOTUS Pick, “I’ll Criticize Judges!”

President Trump on Tuesday said the courts aren’t helping the administration in its attempts to strengthen the country’s vetting procedures to weed out potential terrorists.

“We’re also taking decisive action to improve our vetting procedures,” Trump said, speaking at the National Republican Congressional Committee dinner.

“The courts are not helping us, I have to be honest with you. It’s ridiculous. Somebody said I should not criticize judges. OK, I’ll criticize judges.”

Earlier this year, Trump blasted James Robart, the federal judge for the Western District of Washington who placed a halt on Trump’s initial travel ban. The president referred to Robart as a “so-called judge.”

During the campaign, he also attacked the judge hearing a lawsuit against Trump’s defunct real estate education program, Trump University, saying that his Mexican heritage makes him unable to be impartial.

On Tuesday, Supreme Court nominee Neil Gorsuch said during his confirmation hearing that he finds the president’s criticism of judges’ integrity “disheartening and demoralizing.”

“I know these people and how decent they are, and when anyone criticizes the honesty, integrity and motives of a federal judge, I find that disheartening and demoralizing because I know the truth,” Gorsuch told Sen. Richard Blumenthal (D-Conn.).

“Anyone including the president of the United States?” Blumenthal asked.

“Anyone is anyone,” Gorsuch replied.

Earlier this month, a federal judge in Hawaii issued a temporary restraining order on parts of the president’s revised travel ban.

Trump Lawyers Go After to Teen Who Operates Site That Shows Kittens Punching Him

A new report indicates that Donald Trump‘s lawyers have gone after a teen who operates a gag site.

Interestingly, the report is from the Observer, which is owned by Trump’s son-in-law, Jared Kushner. Perhaps more interesting — the site that received the cease and desist order is one that shows the president being punched by kittens. We’d link to the site, but one of the URLs leads to a 404 error message and the other now leads to porn, courtesy of an opportunistic entrepreneur of some sort.

Anyway, it was created by a 17-year-old girl identified as Lucy. Lucy loves to code and created the site as a “fun little” project to show off her technical skills. The teen had this to say:

I was going to just let this go, but I think it’s, pardon my French, fucking outrageous that the President of the United States has his team scouring the internet for sites like mine to send out cease and desists and legal action claims if we don’t shut down. Meanwhile, he tweets about The Apprentice ratings and sends out power-drunk tweets about phone tapping. HOW ABOUT BEING THE PRESIDENT?

When The Hollywood Reporter caught up to her, Lucy said, “I really just want people to be aware that this is a president who’s clearly more concerned about what people think of him than doing things of substance.”

Litigation is common for the First Family. Melania Trump has sued over reports she was once an escort. Notably, she went after a 69-year-old blogger.

Trump Takes Another Jab at Ex-49ers Quarterback Colin Kaepernick

President Donald Trump on Monday reprised his attacks on former San Francisco 49ers quarterback Colin Kaepernick, telling supporters in Kentucky that “they like when people actually stand for the American flag.”

Standing before a cheering throng at the Exposition Center in Louisville, Trump referenced a report published Friday that anonymously quoted National Football League officials discussing Kaepernick’s slumping prospects as a free agent. Some loathed the police brutality-fueled protest that saw Kaepernick — and others — take a knee during the national anthem last season.

Others feared a backlash from their fans. Still others feared the president himself.

Or, as Trump put it during his Louisville rally: “They don’t want to get a nasty tweet from Donald Trump. Do you believe that?”

The crowd roared and Trump, grinning, continued.

“I said, if I remember that one, I’m going to the people of Kentucky because they like when people actually stand for the American flag.”

This is well-trod territory for Trump. During the campaign, he described Kaepernick as disrespectful, the protest as “a sad thing” and suggested that the quarterback move abroad.

“Maybe he should find a country that works better for him,” he told a radio host in August, according to The Hill.

Director Spike Lee, meanwhile, has come to the quarterback’s defense. In an Instagram post on Sunday, the two posed for a selfie while Lee described the league’s apparent disinterest as “subterfuge” and “skullduggery.”

“What Crime Has Colin Committed?” Lee wrote. “Look At The QB’s Of All 32 Teams. This Is Some Straight Up Shenanigans, Subterfuge, Skullduggery And BS.”

Trump Blasts ‘Fake News’ CNN’s Polls, CNN Fact-Checks Him Live

President Donald Trump attacked CNN, one of his favorite media targets, Monday morning for continuing to conduct polls even though “their election polls were a WAY OFF disaster.”

Trump and other officials from his White House have been frequent critics of polling, emboldened by the president’s surprise victory that went against the predictions of nearly every 2016 poll. CNN, in a poll conducted several weeks before the election with the market research firm ORC International, released a poll showing Democrat Hillary Clinton with a 5-point lead over Trump nationwide.

“Just heard Fake News CNN is doing polls again despite the fact that their election polls were a WAY OFF disaster. Much higher ratings at Fox,” Trump wrote on Twitter, offering a plug for his preferred cable network, Fox News, where he is the recipient of generally favorable coverage.

While Trump’s social media post indicated that CNN had taken a hiatus from polling following the election, the cable network has actually continued to conduct regular polls. One survey, conducted earlier this month, showed deep divisions over key provisions in the Affordable Care Act but strong bipartisan support for a path to citizenship for undocumented immigrants who meet certain requirements.

A CNN poll conducted in January and released just before Trump’s inauguration showed diminishing confidence among respondents in his transition team and one released in early February began tracking his presidential approval rating.

Update

Mediaite reports CNN immediately fact checked Trump on air. Chris Cuomo took notice of Trump’s tweet, and Poppy Harlow reminded Trump on air that “they’re not our polls, they’re Gallup polls.”

“It’s very different to poll people’s opinion of a sitting president as to how they may go vote,” Harlow said. Rucker expressed hope that Trump was watching, to which Cuomo dryly responded, “oh, he’s watching.”
