Trump calls to ban all Muslims

On December 7th, 2015, Republican presidential candidate Donald Trump released a statement calling for the ban on an entire religion from entering the United States of America.

Donald J. Trump is calling for a total and complete shutdown of Muslims entering the United States until our country’s representatives can figure out what is going on. According to Pew Research, among others, there is great hatred towards Americans by large segments of the Muslim population. Most recently, a poll from the Center for Security Policy released data showing “25% of those polled agreed that violence against Americans here in the United States is justified as a part of the global jihad” and 51% of those polled, “agreed that Muslims in America should have the choice of being governed according to Shariah.” Shariah authorizes such atrocities as murder against non-believers who won’t convert, beheadings and more unthinkable acts that pose great harm to Americans, especially women.

 

Mr. Trump stated, “Without looking at the various polling data, it is obvious to anybody the hatred is beyond comprehension. Where this hatred comes from and why we will have to determine. Until we are able to determine and understand this problem and the dangerous threat it poses, our country cannot be the victims of horrendous attacks by people that believe only in Jihad, and have no sense of reason or respect for human life. If I win the election for President, we are going to Make America Great Again.” – Donald J. Trump

Reality

This is, by far, one of the most bigoted statements Trump, or any other politician, has made in my lifetime. The lies used to push a nationalistic agenda places him in history among the likes of France’s National Front.

Does a President have this authority?

Trump has asserted that U.S. immigration law would grant him the authority to institute
the ban. Although he has not cited any particular provision, it appears he is invoking 8 US Code § 1182(f) the authority vested in the president to suspend entry of “any class of aliens.”

But Congress cannot grant, and a president cannot exercise, authority that would violate the Constitution.  In light of the constitutional flaws in Trump’s proposed ban, § 1182(f ) either must be read narrowly not to authorize such unconstitutional conduct, or it should be struck down as unconstitutional insofar as it authorizes such a ban.

Is Trump’s proposal constitutional?

A ban on Muslim U.S. citizens from entering the United States would be a blatant violation of due process and equal protection under the Fifth Amendment and the basic principle that the government may not banish its citizens or deny them entry to the United States.

In addition, any religion-based bar on the readmission of lawful permanent residents — who have a lawful right to readmission (particularly after a brief trip abroad) unless and until the government can prove they should lose that right — should fail under the Due Process Clause.

What about Trump’s evidence he used for justification of a ban?

While the study Trump cited does exist, it’s not at all clear that it supports his argument that “there is great hatred towards Americans by large segments of the Muslim population.” There are several important problems with the survey that call into question whether the results are representative of the entire U.S. Muslim population. It was an online, opt-in survey, which tend to produce less reliable samples because respondents choose to participate. In traditional polling methods, everyone in a population has a chance of being selected for the survey, meaning the results generally reflect the country’s demographics.

Trump Plans on Banning All Muslims from Entering the United States

In a press release by Donald Trump’s campaign and reiterated in almost every Republican debate:

Donald J. Trump is calling for a total and complete shutdown of Muslims entering the United States until our country’s representatives can figure out what is going on.

Until we are able to determine and understand this problem and the dangerous threat it poses, our country cannot be the victims of horrendous attacks by people that believe only in Jihad, and have no sense of reason or respect for human life.

Reality

While Korematsu v. United States has never been challenged and could be a slim avenue for implementation, most legal scholars would deem this bigoted plan unconstitutional. Trump’s proposal would violate the First Amendment’s Religion Clauses, the equality dimension of the Due Process Clause of the Fifth Amendment, and the Constitution’s general prohibition on religious tests outside of the immigration context as it would also conflict with the spirit of the No Religious Test Clause of Article VI.

Trump Condones Roughing Up Protester

Trump supporters beat Black Lives Matter protester

Trump instructed security to eject a Black Lives Matter protester from a campaign event in Birmingham, Alabama.

“Get him the hell out of here, will you please?” Trump asked. “Get him out of here. Throw him out!”

The protester was shoved by the police out of the venue and heckled by Trump supporters, who shouted, “Get the fuck out of here, man,” and “Tase him!”

Following the altercation, Trump went on Fox News and said:

Maybe [the protester] should have been roughed up, because it was absolutely disgusting what he was doing.

Comments like these add to the growing evidence that Donald Trump supports and condones violence against people with different ideas.

Trump Retweets, Then Deletes, Racist Image Tying Jeb Bush to Nazis

Republican presidential candidate Donald Trump on Tuesday night retweeted — and promptly deleted — a collage attacking his GOP primary rival Jeb Bush that featured a swastika.

The tweet, which Trump manually reposted, was quickly circulated by various Twitter users and reporters, who took screenshots of the image and reposted them.

Trump tweets "ADIOS, JEB aka JOSE" with racist and Nazi imagery.

In addition to a swastika, the collage also used Hispanic stereotypes to promote an anti-immigration reform agenda. The campaign said Wednesday morning that Trump did not realize the image included offensive imagery.

“This was retweeted by Mr. Trump like hundreds of others. He did not see the accompanying image and the retweet has since been deleted,” Trump spokeswoman Hope Hicks said in an e-mail.

Last month Trump’s account tweeted a comment disparaging Iowa voters who support his rival Ben Carson, insinuating they lacked intelligence. In July, Trump’s account tweeted a graphic that inadvertently used images of Nazi soldiers.  In both instances, Trump said that an intern had committed the error.

Trump Supporters Harass Immigration Protesters In Iowa

A group of students at Iowa State called Students Against Bigotry staged a protest in the parking lot of the campus’ Jack Trice Stadium. They were confronted by a group of Trump supporters who hurled racial epithets and insults, and one woman reached out and tore a student’s signs to pieces.

Trump Keeps Hitler Book in a Cabinet by His Bed

According to a 1990 Vanity Fair interview, Ivana Trump once told her lawyer Michael Kennedy that her husband, real-estate mogul Donald Trump, now a leading Republican presidential candidate, kept a book of Hitler’s speeches near his bed.

“Last April, perhaps in a surge of Czech nationalism, Ivana Trump told her lawyer Michael Kennedy that from time to time her husband reads a book of Hitler’s collected speeches, My New Order, which he keeps in a cabinet by his bed … Hitler’s speeches, from his earliest days up through the Phony War of 1939, reveal his extraordinary ability as a master propagandist,” Marie Brenner wrote.

When Brenner asked Trump about how he came to possess Hitler’s speeches, “Trump hesitated” and then said, “Who told you that?”

“I don’t remember,” Brenner reportedly replied.

Trump then recalled, “Actually, it was my friend Marty Davis from Paramount who gave me a copy of ‘Mein Kampf,’ and he’s a Jew.”

Brenner added that Davis did acknowledge that he gave Trump a book about Hitler.

“But it was ‘My New Order,’ Hitler’s speeches, not ‘Mein Kampf,'” Davis reportedly said. “I thought he would find it interesting. I am his friend, but I’m not Jewish.”

After Trump and Brenner changed topics, Trump returned to the subject and reportedly said, “If, I had these speeches, and I am not saying that I do, I would never read them.”

Reality

Trump confirmed he owned the book but denies ever reading it. Until evidence is presented that proves he read the book or takes cues from it then this is as far as the story goes.

However let me just add this. There should only be 2 valid reasons why you should own a copy of Hitler’s “My New Order”:

  1. You are studying 1930’s Germany.
  2. You are a neo-Nazi.

This is purely hypothetical, but if my good friend gave me a copy of a book authored by Hitler, I would not keep it easily accessible in cabinet next to my bed. Instead I would put it in the trash or at least in a box in the attic should the occasion arise that my friend asks me if I still have the book, to which I can go to the attic, pull out the book, show it to my friend, tell him that it sucks, and ask him why is he still my friend?

Trump Tweets Photos of Nazi Soldiers

Real-estate developer Donald Trump’s Twitter account deleted a tweet on Tuesday that contained small images that some people identified as World War II-era Waffen-SS soldiers.

On the surface, Trump’s tweet was innocent enough. It featured a photo of the Republican presidential candidate embedded in an American flag. Within each of the three visible red stripes were photos of money, the White House, and soldiers.

But former National Security Agency analyst John Schindler repeatedly wrote on Twitter that the men at the bottom of the photo were actually Nazi soldiers.

Trump’s campaign subsequently deleted the tweet and told The Hill that an intern was at fault. Michael Cohen, a Trump spokesman, reportedly pointed to Trump’s Tuesday event in Charlottesville, Virginia, and said the real-estate developer was not involved in the creation of the image.

“A young intern created and posted the image and did not see the very faded figures within the flag of the stock photo,” Cohen told the paper. “The intern apologized and immediately deleted the tweet.”

Reality

In all honesty this is probably just what it seems, an intern not knowing any better. But it doesn’t exactly help Trumps image when it comes to white supremacy.

Mother Jones was able to track down the original stock photo and photographer, apparently shot during a reenactment.

Trump Rallies a New “Silent Majority”

Donald Trump claims that he rallies a new “Silent Majority”. For those not familiar with politics, the Southern Strategy focus on motivating the “Silent Majority” which is a racist code word for “white people.”

“It comes deeply from Richard Nixon’s basic political orientation,” said Rick Perlstein, a historian who has written multiple books on conservatism and the Nixon era, including Nixonland: The Rise of a President and the Fracturing of America and The Invisible Bridge: The Fall of Nixon and the Rise of Reagan.

The language of the silent majority, was a distillation of Nixon’s political philosophy, “the idea that there are two kinds of Americans — the ordinary middle-class folks with the white picket fence who play by the rules and pay their taxes and don’t protest and the other are the people who basically come from the left.”

And over time, the term silent majority was used to exclude more than just anti-war protesters. The “noisy minority,” as Perlstein called it, was fairly large. “It was black civil rights militants,” he said. “It was feminists who were supposedly burning their bras. It was students who were smoking drugs. It was rock ‘n’ roll bands. It was everything that threatened that kind of 1950s Leave It to Beaver vision of what America was like before everything literally and figuratively went to pot.”
